Manitoba makes changes to the Partnership Act

WINNIPEG - The province is amending it's Partnership Act so that individuals who are found to be negligent are held solely responsible, instead of all of the partners involved. These changes are expected to protect innocent partners from claims made against another partner. The province also plans on amending the Business Names Registration Act to include this protection as well.

"This legislation allows for the creation and registration of limited liability partnerships in Manitoba," said Finance Minister Greg Selinger. "In our global environment where professional partnerships often work in different locations, it's no longer possible for all partners to be aware of the activities of others."

In the case of limited liability partnerships, each partner can be held responsible for the actions of the other partners if they had prior knowledge of the events and didn't try to prevent them. Partners whose employees act in a negligent manner can also be held responsible for these actions in a limited liability agreement.

Lawyers and accountants in the province will soon be able to set up their practices as limited liability partnerships. Under the amended legislation they will be required to hold liability insurance policies to protect against possible negligent actions.
