Stat holidays

Expert: Julie King

Jac asked:

I am trying to figure out my stat holiday pay for Good Friday. From what I understand I take my regular wages earned in the four work weeks prior to the public holiday plus any vacation pay payable during that period, divided by 20.

My question is ... during March break I am not paid because our office is closed. Do I calculate that into the four weeks?

Julie King answered:

From your email address it looks like you are based in Ontario. This fact sheet on the Ontario Employment Standards website explains how Stat pay is calculated:

http://www.labour.gov.on.ca/english/es/factsheets/fs_public.html

I checked with a representative from the Ministry of Labour, and was told that if the office was closed for a week during the four week period before the public holidya, then you would calculate that into the four weeks.

If you received vacation pay during that time your pay will likely not be affected. However, if the week when the office was closed took the form of an unpaid leave, your vacation pay will be lower than it would have if the office had not been closed.
