Payment for a stat holiday

Jennifer asked:

If my employer closes down business operations the week before and the week of a stat holiday, are we still eligible for Stat Holiday pay? I am in Ontario, what are the laws about this?

Howard Levitt answered:

If the business is closing down for a temporary period, and you have worked the day before and after the shutdown, then you will be entitled to pay for the stat holiday.

However, if the business has shut down for good, you are not entitled to payment for the stat holiday, but you will be entitled to termination pay.
